By creating an Index.brain account or using any part of our service, you agree to be bound by these Terms of Service ("Terms"). If you use Index.brain on behalf of a company or organization, you represent that you have the authority to bind that organization to these Terms, and "you" refers to both you and that organization. If you do not agree to these Terms, do not use the service.
Index.brain is a knowledge extraction service. We connect to your business tools (Gmail, Slack, Notion, Jira, Linear, Asana, GitHub, and others), extract structured knowledge, organize it into AI-readable skills, and deliver those skills to authorized AI agents via MCP and REST API.
We do not store raw emails, messages, or documents. We extract knowledge and discard the source content. We are not an automation platform, a workflow builder, a document management system, or an AI agent — we are the knowledge layer that makes your existing AI agents smarter about your company.
Processing is not real-time. The brain updates every few hours. This ensures higher-quality knowledge extraction and is a deliberate product decision.
You own your data. By connecting an integration, you grant Index.brain a limited, non-exclusive license to read data from that source for the sole purpose of extracting and structuring knowledge for your account. You can revoke this permission at any time by disconnecting the integration.
You are responsible for ensuring you have the right to connect the data sources you connect to Index.brain. You represent that connecting those sources and allowing us to process the data in them does not violate any applicable law, regulation, or third-party agreement.
We do not claim any ownership rights over the knowledge extracted from your data. The extracted skills and facts belong to you.
You agree not to use Index.brain to:
Violation of these rules may result in immediate suspension or termination of your account.
API usage is subject to rate limits based on your plan:
Requests that exceed your limit will receive a 429 response with a reset timestamp. We do not charge overage fees — excess requests are throttled, not billed.
We aim for high availability but do not guarantee uninterrupted service. Index.brain depends on third-party services (Gmail APIs, Slack APIs, Anthropic API, Vercel) that may experience their own outages. We are not liable for downtime caused by events outside our control. Scheduled maintenance will be announced in advance on our status page at status.indexbrain.online.
Index.brain and its software, design, and brand are owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our name, logo, trademarks, or software except the limited right to use the service as described here.
If you submit feedback, suggestions, or ideas about the service, you grant us the right to use that feedback without compensation or attribution.
Both parties agree to keep each other's confidential information (including account contents, pricing, and business terms) confidential and not to disclose it to third parties without consent, except as required by law. This obligation survives termination of these Terms.
Index.brain is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be error-free, uninterrupted, or that extracted knowledge will be accurate or complete. AI extraction is inherently probabilistic — always review critical knowledge before relying on it.
To the maximum extent permitted by law, Index.brain and its directors, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service.
Our total aggregate liability for any claim arising from these Terms or the service is limited to the greater of (a) the amount you paid us in the 12 months immediately preceding the event giving rise to the claim, or (b) $100 USD.
You agree to indemnify and hold harmless Index.brain and its directors, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the service, your violation of these Terms, or your violation of any third-party rights.
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.
Any dispute arising from these Terms or the service will first be addressed through good-faith negotiation. If unresolved after 30 days, disputes will be resolved by binding arbitration under the rules of the American Arbitration Association, conducted in English. You waive any right to participate in class actions.
We may update these Terms from time to time. Significant changes will be communicated by email at least 30 days before they take effect. The updated Terms will be posted on this page with a new "Last updated" date. Continued use of the service after the effective date constitutes acceptance of the updated Terms.
